Military Law – No Longer Just for the Military: Article 32 Redefined

Military law is Title 10 in its entirety and by definition it is martial law. Article 32 of the Uniform Code of Military Justice (UCMJ) (Section 832 of Title 10, United States Code) is an important portion of Title 10, or Military law. Article 32 of the UCMJ “requires a thorough and impartial investigation of charges and specifications before they may be referred to a general court-martial.” This is akin to a Grand Jury investigation for Military personnel only. But now, American Civilians are coming under Article 32 military tribunals. Well folks, they’re at it again. This time we are all included. Yep, that’s right. We are all enemy belligerents. And just why do I say that? I’ve read the thing, S. 3081 that is, and pondered on it for a bit, and there’s just no gettin’ around it. Cranky ol’ me and my obstinate ways just might classify me as belligerent in some way, shape or form. Yep, that’s right. You too, if you do any of the following:

You might be an enemy belligerent and detained without trial if…

You might know something that the government wants to know.

The president says so.

It is determined that you have links to Al-CIA-DA.

Hey, wait just a darn minute! Hold onto your horses, folks. Didn’t the U.S. government create Al-CIA-DA? According to this bill, that means that the U.S. government itself and all the staffers in it are subject to interrogation and detention without trial until whatever conflict is going on is over. This bill might not be so bad after all…

Who is Lt. Eric Shine, and why should we care?

Lt. Eric Shine is a graduate of the United States Merchant Marine Academy at Kings Point and is an expert in the history of the United States Merchant Marine, as well as issues relating to shipping and national security.

In his role as a whistle blower, Lt. Shine has taken his oath of office seriously, and has held himself to his academy motto Acto Non Verba or “Deeds Not Words” and taken it to new heights. Lt. As usual, the U.S. government’s official position on the living conditions of women in Afghanistan is rosy. Things are improving, and we are proud of our country’s role in their liberation.

Kenyan-born Barack Hussein Obama has recently sent even more troops into Afghanistan, so things should be getting better, eh?

Here is the State Department’s official position on the plight of women in Afghanistan:

In late 2001, in the infancy of Operation Enduring Freedom, the U.S. war waged in Afghanistan, President George W. Bush signed into law the Afghan Women and Children Relief Act of 2001. This law authorized the president to allocate funds to organizations like UNICEF that promote human rights of women and children. (S. 1573) In a joint statement in early 2002, then-President George W. Bush and Chairman Hamid Karzai issued a joint statement, articulating their support for the cause of protecting women’s human rights in Afghanistan, and stated it was their pledge to “ensure women can gain the skills and education deprived them under years of Taliban mis-rule.” (Bush and Karzai) Continue reading
